Terms of Use

1. Agreement

These Terms are an agreement between you and Marek Dieška, an individual developer based in Slovakia who publishes as Apakhian Games (“we”, “us”). They apply when you download, install or use the Guesser Space app for Android and this website. By using the app you accept them. If you don’t agree, please don’t use the app.

Nothing in these Terms takes away rights you have by law as a consumer.

2. The app

Guesser Space is a collection of short games: daily puzzles that reset at midnight on your device, timed games with leaderboards and arcade modes, in sections for geography, history, puzzles, numbers, words, chemistry, art and more. It also has streaks, levels, achievements, a Shop that uses an in-game currency, collectible creatures, friends, sharing, and Rendezvous, a daily match between two friends. The current list of games is on the home page.

The app is available for Android through Google Play. Some features, such as Guess the Art, Rendezvous, friends, leaderboards and the Shop, need an internet connection.

We keep improving the app, so games, features, rewards and prices of virtual items can be added, changed or removed over time.

3. Your account

• You can play your first game without an account. To keep playing, and to buy Pro, you need to sign in with a Google account.
• Your progress is stored with the Google account you sign in with. Keep that account secure; we can’t restore access to a Google account for you.
• One account is for one person. Don’t share it, sell it or use someone else’s.
• You choose a player name, and optionally a bio. They must follow section 8.
• You can switch between Google accounts in the app; each keeps its own progress.
• You can ask us to delete your account at any time, as described on Delete your account. Deleting it removes your progress, virtual items and any Pro creatures for good.

4. Trials, referrals and promo codes

Free trials. When Google Play offers a free trial of Pro, its length and terms are shown in the app and in Google Play before you start it. Unless you cancel before the trial ends, it turns into a paid subscription. The app reminds you two days before the end.

Referral codes. Every player has a code (it’s also the code friends use to add you). When someone redeems your code, they and you each get seven days of Pro.

• You can redeem one referral code, and never your own.
• A code can be redeemed a limited number of times, currently three.
• Creating extra accounts, using emulators, scripts or other tricks to collect rewards, or trading codes for money is not allowed.

Promo codes. We sometimes hand out promo codes that unlock Pro for a period or permanently. They’re entered in the same place as referral codes and may have their own conditions.

Codes are checked on our server. We can refuse, reverse or adjust a referral or promo benefit if we reasonably believe it was obtained through abuse, fraud or a technical error. Trials and code benefits have no cash value and can’t be transferred.

5. Pro subscription

What it is. Pro is an optional subscription that unlocks the games marked Pro, two Pro-exclusive creatures and two Pro flares. What Pro includes is described on the Pro page in the app and may change over time.

Price and billing. There are monthly and yearly plans. Google Play bills them, in your local currency, at the price shown to you in the app and in Google Play before you confirm. Subscriptions renew automatically at the end of each period unless you cancel.

Cancelling. Cancel any time in Google Play under Payments & subscriptions › Subscriptions, or through Manage Subscription in the app. Pro stays active until the end of the period you’ve paid for. Uninstalling the app does not cancel a subscription.

Refunds and your rights. Refunds are handled by Google Play under its refund policy. If you’re a consumer in the EU or the UK you may have a statutory right to withdraw from a purchase within 14 days; for digital content and services that start immediately at your request, that right can end once they’ve started, as explained when you buy. This doesn’t limit any right you have by law.

When Pro ends. The Pro games lock again. Everything you earned while subscribed stays with your account, including the Pro creatures. Pro flares can only be used while Pro is active.

6. Intergalactic Cash and other virtual items

The app has an in-game currency, Intergalactic Cash, and virtual items: Streak Freezes, XP and Cash boosters, banner colors, game skins, creatures, flares and achievements.

• They are earned by playing, and Cash is spent only in the app’s Shop. They can’t be bought with real money.
• They have no value outside the app. They can’t be exchanged for money, sold, traded or transferred to another account, and we don’t buy them back.
• You get a personal, revocable licence to use them in the app; you don’t own them.
• Shop offers and prices change daily, and rewards may be rebalanced over time.
• We may correct balances and items that were received through a bug, an error or a breach of these Terms.
• If your account is deleted or terminated, its Cash and items are gone.

7. Fair play

Leaderboards, rewards and Rendezvous only work if everyone plays honestly. You must not:

• use bots, scripts, macros, modified or emulated versions of the app, or automate play,
• exploit bugs or vulnerabilities, or tamper with the data the app sends, including scores, times and Rendezvous results, which your device reports,
• create or control several accounts to gain rewards, scores or referral benefits,
• interfere with our servers or try to access accounts, data or features that aren’t yours.

If we reasonably believe you have, we may remove scores from leaderboards, reverse rewards, reset or remove virtual items, or restrict your account. If you find a vulnerability, please report it to mdieska1@gmail.com instead of using it.

8. Other players and what you post

Player names and bios must not be offensive, hateful, sexual, threatening, misleading, infringing, or pretend to be someone else, including us. Names are checked against a list of offensive words, but you remain responsible for what you choose. We may change or remove a name or bio that breaks this rule.

Friend requests, co-pilot invites, nudges, shares and reactions are for playing together. Don’t use them to harass, spam or bother anyone. You can remove or block any player at any time.

The Suggestion Box is for feedback about the app. Don’t send unlawful, abusive or infringing content, or personal information you wouldn’t want us to read. If you send us an idea, you allow us to use it to improve the app without owing you anything for it.

9. Our content

The app, including its software, games, puzzles, design, illustrations, creatures, texts and the Guesser Space name, belongs to Marek Dieška or to the licensors listed in section 10, and is protected by copyright and other laws.

We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial entertainment, under these Terms and Google Play’s terms. You may not copy, modify, sell or redistribute the app, or reverse-engineer it except where the law allows.

10. Third-party content and services

Some content in the app comes from others:

• artwork images from Wikimedia Commons, each under its own licence or in the public domain,
• historical event data licensed under the Open Database License (ODbL),
• word definitions in Constellation from Linguabase by IDEA.org, released under CC0,
• the ENABLE word list, in the public domain, for Finish the Board,
• Sudoku puzzles from the Sudoku Exchange Puzzle Bank,
• country flags from flagcdn.com,
• icons from Boxicons (MIT License) and Material Icons by Google (Apache License 2.0).

The app also relies on services run by other companies, mainly Google (Firebase and Google Play) and RevenueCat. Their own terms apply to how they provide those services: Google Terms of Service · Google Play Terms of Service · RevenueCat Terms

We aren’t responsible for outages, policy changes or billing systems outside our control.

11. Availability

We work to keep Guesser Space running smoothly, but we can’t promise it will always be available, error-free or unchanged. Features that depend on our servers, such as rewards, leaderboards, friends, Rendezvous and the Shop, may occasionally be unavailable. Daily content, games and features may change, and we may end the app altogether; if we do, we’ll try to give reasonable notice in the app.

12. Disclaimer

The app is provided “as is” and “as available”. To the extent the law allows, we make no promises about it beyond those in these Terms. Your statutory rights as a consumer, for example regarding digital content that isn’t as described, are not affected.

13. Liability

We’re not liable for indirect or unforeseeable losses, or for lost data, profits or opportunities, arising from your use of the app, to the extent the law allows. Nothing in these Terms limits liability for intent or gross negligence, for death or personal injury caused by negligence, or any other liability that can’t be limited by law.

14. Suspension and termination

You can stop using Guesser Space at any time and ask us to delete your account. We may suspend or end your access, in whole or in part, if you seriously or repeatedly break these Terms, if the law requires it, or if your use puts other players or the service at risk. Where reasonable, we’ll tell you why. This doesn’t cancel a Google Play subscription; manage that in Google Play.

15. Changes to these Terms

We may update these Terms when the app or the law changes. We’ll change the date at the top of this page and list earlier versions below; for significant changes we’ll also try to tell you in the app. If you keep using the app after a change takes effect, the updated Terms apply. If you don’t agree with them, stop using the app and, if you like, ask us to delete your account.

16. Law and disputes

These Terms are governed by the laws of the Slovak Republic. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of that country or of Slovakia. Before going to court, please write to us; most problems can be solved by email.
